ITAR can restrict not only the export of U.S. weapons but also the re-export of systems containing U.S.-controlled components or data.<\/p>\n\n\n\n<p><strong>ITAR in Law<\/strong><\/p>\n\n\n\n<p>In legal terms:<br>\u2022 ITAR applies to U.S.-origin defence technology<br>\u2022 Company ownership alone does not automatically trigger ITAR jurisdiction<\/p>\n\n\n\n<p>On paper, the acquisition of a French supplier by a U.S. firm does not automatically place Rafale under U.S. control.<\/p>\n\n\n\n<p><strong>ITAR in Practice<\/strong><\/p>\n\n\n\n<p>However, history matters as &#8220;The United States&#8221; has repeatedly demonstrated that ITAR is not applied purely as a technical rulebook. It has been used as a strategic and political instrument, including:<br>\u2022 Delaying or blocking third-party exports<br>\u2022 Imposing compliance reviews at critical moments<br>\u2022 Using regulatory ambiguity as leverage in negotiations<\/p>\n\n\n\n<p>Even limited U.S. involvement compliance oversight, managerial access, or future technology insertion \u2014 can provide grounds for asserting jurisdiction.<\/p>\n\n\n\n<p>This is why concerns around the LMB acquisition are not imaginary.<\/p>\n\n\n\n<p><strong>The Golden Share: France\u2019s Structural Safeguard<\/strong><\/p>\n\n\n\n<p>A key element often overlooked in public discourse is the French government\u2019s golden share in LMB Aerospace.<\/p>\n\n\n\n<p>The acquisition was approved under France\u2019s foreign investment screening regime, which applies strict controls to defence-related assets. As part of this approval, the French state retained a golden (preferred) share.<\/p>\n\n\n\n<p><strong>What the Golden Share Enables<\/strong><\/p>\n\n\n\n<p>The golden share gives France the legal authority to:<br>\u2022 Veto changes to strategic activities<br>\u2022 Block relocation of production, R&amp;D, or key personnel<br>\u2022 Prevent unauthorised technology transfer<br>\u2022 Intervene if ownership decisions affect defence readiness or delivery timelines<\/p>\n\n\n\n<p>In practical terms, this means France retains decisive control over how LMB operates on French soil.<\/p>\n\n\n\n<p>If delays are induced whether commercially or due to external pressure, the French state has the authority to intervene directly.<\/p>\n\n\n\n<p><strong>What the Golden Share Does Not Do<\/strong><\/p>\n\n\n\n<p>To be precise:<br>\u2022 It does not nullify U.S. law<br>\u2022 It cannot prevent Washington from asserting ITAR jurisdiction externally<br>\u2022 It cannot force U.S. export approvals<\/p>\n\n\n\n<p>However, it prevents U.S. ownership from being converted into operational leverage inside France and weapons getting assembled in France.<\/p>\n\n\n\n<p><strong>This distinction is crucial.<\/strong><\/p>\n\n\n\n<p>Most ITAR leverage works through supply-chain disruption and procedural delays.
